Privacy NoticesĀ (formerly Fair Processing Notices)

Under The Data Protection Act 1998 and GDPR (General Data Protection Regulation) which comes into force in May 2018, when an organisation collects personal information about an individual it should use a Privacy Notice to provide details of how data is used.

Model Privacy Notices: Model Privacy Notices with suggested text are available on the DfE website at the link below.  The models are updated from time to time, so it is useful to check that you are using the most recent version.  Note however that these are just models and schools will need to amend them to ensure they reflect the specific details of how they use data: www.gov.uk/government/publications/data-protection-and-privacy-privacy-notices  

WBC have in the past produced versions based on the DfE models.  However, for the privacy notice for 'Pupils' and 'School workforce' we think it is now more efficient in general if schools use the DfE model templates themselves from the link above as the basis.  Where schools share data with Wokingham Borough Council (all Local Authority schools and most Academies currently) we suggest that text such as suggested below is included in the privacy notice:

"For more information about how Wokingham Local Authority processes data, please visit: http://www.wokingham.gov.uk/council-and-meetings/information-and-data-protection/"

In addition however, the Wokingham 'ICT in Schools' team has been working to produce a sample Privacy Notice for Pupils, based on the DfE model.  Once this is ready (which will be before the start of the GDPR regulations) it will be posted on the ‘login only’ GDPR area of the Wokingham Schools Hub which can be accessed using this link: Additional GDPR information, FAQs and GDPR forum.  A template Data Protection policy will also be made available.

On the DfE website link above there is also a privacy notice for 'Looked-after children and children in need'.  Our current understanding is that this is for Local Authorities to make available (rather than schools), so it is anticipated that a WBC model will be made available in due course.
